These Terms of Service ("Terms") govern your access to and use of the Feedetta application, website (including https://feedetta.com), Progressive Web App (PWA), and associated services (collectively, the "Service"). The Service is owned, developed, and operated by **TallyTic LLC**, a Washington State limited liability company ("TallyTic", "we", "us", or "our"). These Terms are an agreement between you and TallyTic LLC, the provider of the Service. Members, managers, employees, and contractors acting on its behalf are not individually parties to this agreement. Before using the Service, you must expressly agree to these Terms and acknowledge receipt of the Privacy Policy. You can review the legal documents and export existing data without agreeing. If you do not agree, stop using the Service. Our [Privacy Policy](/privacy) explains how information is handled when you use the Service. The [document history](/legal-history) preserves published versions. Acknowledging the Privacy Policy confirms receipt of the notice; it is not consent to optional marketing or tracking. --- ## 1. Description of the Service Feedetta is an offline-first web application for reading feeds and listening to podcasts. It enables users to: - Subscribe to publicly available RSS, Atom, and JSON feeds. - Stream podcast audio from publishers, directly or through our relays when needed. - Cache and download podcast episodes for offline playback on supported devices. - Optionally synchronize subscriptions, folders, item state, playback progress, queues, and supported preferences across devices using passwordless email sign-in. --- ## 2. Intellectual Property & Ownership - **Permission to Use Feedetta:** Subject to these Terms, TallyTic LLC grants you a limited, non-exclusive, non-transferable right to access and use the Service and install its PWA for your own use. - **Proprietary Software:** Feedetta's original software, design, and user interface are the intellectual property of **TallyTic LLC**. Except for the permission above, a separate written agreement, or rights provided by applicable law, you may not copy, modify, reverse engineer, decompile, or distribute Feedetta's proprietary software. All other rights are reserved. - **Open-Source Components:** Feedetta uses third-party open-source software governed by its own licenses. These Terms do not limit rights granted by those licenses. See the [Acknowledgements](https://feedetta.com/acknowledgements) and [third-party license notices](/third-party-notices.txt). - **Trademarks & Branding:** The names "Feedetta", "TallyTic", and associated logos, trademarks, domain names, and trade dress are the intellectual property of **TallyTic LLC**. Nothing in these Terms grants you any right, title, or interest in our trademarks, logos, or commercial branding. --- ## 3. Third-Party Content & RSS Feeds - **Reader and Podcast Client:** Feedetta retrieves, parses, relays, and displays publicly accessible feeds and media published by third parties. It can also extract article text from publisher pages and display embedded media. - **No Ownership or Endorsement:** TallyTic LLC does not own or control third-party feeds, podcasts, articles, audio recordings, show notes, or external links accessed through the Service. Feedetta may retrieve, relay, temporarily cache, and display that content and show discovery results from third-party catalogs. Availability in Feedetta does not constitute endorsement, affiliation, or a guarantee of accuracy, safety, legality, or availability. - **Publisher Intellectual Property:** All copyrights, trademarks, and intellectual property rights in third-party feeds, article text, audio files, transcripts, and artwork remain exclusively with their respective creators, publishers, and licensors. - **User Responsibility:** You must ensure that your access to, downloads of, and use of third-party content comply with applicable law and publisher terms. A public feed, an extraction feature, or a download button does not grant permission to redistribute content or bypass a paywall or access restriction. Publishers may include advertising or tracking in their content; Feedetta does not control those practices. --- ## 4. Acceptable Use Policy You agree not to use the Service to: 1. Abuse, overload, or attempt to disable the Service's infrastructure, including its content relays and synchronization services. 2. Bypass security measures or access controls, or attempt unauthorized access to systems or data. 3. Use automated bots, scrapers, or scripts to flood or abuse Feedetta's serverless functions. 4. Violate any applicable local, state, national, or international law or regulation. TallyTic LLC reserves the right to suspend or block access to edge relays or sync infrastructure for any user or IP address found violating this Acceptable Use Policy. --- ## 5. Local Storage, Offline Use & Synchronization - **Local Storage:** Your library and downloaded media are stored in your browser. Without sync, TallyTic LLC does not maintain a server-side backup of your local library or playback state. Network requests, relay caches, and operational logs are described in the Privacy Policy. Browser storage may be cleared or lost, including after you grant persistent storage or install the PWA. - **Exports:** OPML exports subscriptions and folders. JSON exports feed settings, preferences, and item state, but not article text or downloaded audio. Feedetta currently imports OPML only and cannot restore a JSON export. Keep copies of information you need; sync and exports are not complete backups of all content on your device. - **Cross-Device Sync:** If you enable sync, you provide your email address for sign-in links and verification codes. You are responsible for safeguarding your email account. Row-level security restricts ordinary client access to synced records to your authenticated account; authorized administrative access is described in the Privacy Policy. Synced records are not end-to-end encrypted. Signing out or resetting the local library does not delete your cloud account or synced records. - **Acknowledgement Records:** Signed-out acknowledgements are stored on the device and do not identify a person. Clearing that storage removes the record. Signed-in acknowledgements are associated with your account and include the exact document versions, content hashes, the time reported by your device, and a separate server receipt time. Offline acknowledgements may be queued for recording when connectivity returns; account sync requires a server-recorded acknowledgement. Signing in after using the app as a guest requires a separate explicit account acknowledgement. We do not infer agreement from earlier use or backdate account records. --- ## 6. Disclaimer of Warranties TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW: 1. THE SERVICE IS PROVIDED ON AN **"AS IS"** AND **"AS AVAILABLE"** BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. 2. TALLYTIC LLC EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. 3. TALLYTIC LLC MAKES NO WARRANTY OR REPRESENTATION THAT: - THE SERVICE WILL MEET YOUR REQUIREMENTS; - THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; - LOCAL BROWSER STORAGE OR CACHED AUDIO WILL NOT BE EVICTED BY YOUR OPERATING SYSTEM OR BROWSER (E.G., BROWSER STORAGE QUOTAS); - ANY THIRD-PARTY RSS FEED, PODCAST CDN, AUDIO ENCLOSURE, OR EXTERNAL LINK WILL REMAIN OPERATIONAL OR ACCESSIBLE. --- ## 7. Limitation of Liability TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL **TALLYTIC LLC**, ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, OR AGENTS BE LIABLE FOR ANY: 1. INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES; 2. LOSS OF PROFITS, DATA, USE, GOODWILL, REPUTATION, OR OTHER INTANGIBLE LOSSES; 3. DAMAGES ARISING OUT OF OR IN CONNECTION WITH: - YOUR ACCESS TO, USE OF, OR INABILITY TO ACCESS OR USE THE SERVICE; - ANY CONTENT OBTAINED FROM THIRD-PARTY PODCASTERS, PUBLISHERS, OR RSS FEEDS; - UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR LOCAL STORAGE OR SYNCED DATA; - ANY BUGS, VIRUSES, OR SERVICE DISRUPTIONS EXPERIENCED THROUGH THE SERVICE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF TALLYTIC LLC AND THE PERSONS LISTED ABOVE FOR CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS SHALL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100.00 USD) OR THE AMOUNT PAID BY YOU TO TALLYTIC LLC FOR THE SERVICE IN THE PRECEDING TWELVE (12) MONTHS. These exclusions and limitations apply whether a claim is based on contract, tort, or another legal theory. Nothing in these Terms excludes liability or limits consumer rights or remedies that cannot lawfully be excluded or limited. --- ## 8. Indemnification To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless TallyTic LLC, its members, managers, officers, employees, contractors, and agents from third-party claims, liabilities, damages, losses, costs, and reasonable attorneys' fees arising from: 1. Your unlawful use or misuse of the Service; 2. Your violation of these Terms; or 3. Your infringement or violation of any third-party intellectual property or privacy right. This obligation does not apply to the extent a claim results from the protected party's own unlawful conduct or to the extent prohibited by applicable law. --- ## 9. Modifications to the Service and Terms TallyTic LLC may modify, suspend, or discontinue the Service, including content relays and synchronization, subject to any notice or other obligations required by applicable law. We may revise these Terms from time to time. Each published version is preserved in the document history. Changes requiring renewed agreement will be identified with a summary, and Feedetta will ask you to agree to the required version before continuing to use the app. Editorial changes may be published without requiring renewed agreement. We will provide any additional notice or obtain consent required by applicable law. If you do not agree to required changes, stop using the Service; you can still review the legal documents and export your existing data. --- ## 10. Governing Law These Terms and any dispute arising out of or related to them or the Service shall be governed by the laws of the State of Washington and applicable federal laws of the United States, without giving effect to conflict-of-law principles. This choice of law does not deprive you of mandatory consumer protections under laws that otherwise apply to you. --- ## 11.
